Joy! Become a Product Tester: Promotion 2023 Terms and Conditions

1. Participation in this promotion is deemed acceptance of these terms and conditions.
2. This promotion is applicable only to those who entered the promotion entry form
https://joy.co.nz/pages/become-a-product-tester during the promotion period (see clause
5).
3. You (the “claimant”) must be an Auckland (NZ) resident aged at least 18 who is not (a) an
employee or immediate family member of an employee of Beds R Us (the “promoter”) or
agencies associated with the promotion.
4. At the conclusion of the promotion, Joy! Product Testers will be selected via a random generator and receive a complimentary Joy! mattress (Queen OR King) – you may only enter once. Once the promotion period has concluded by 29th March 2023, the promoter will select the winners on Wednesday 29th March 2023 and send out the mattress within 4 days of a claim being approved and the winner’s address being provided.
5. Entrants selected to become a Joy! Product Tester will be notified via email. Those selected
must confirm their acceptance including confirmation of their personal details within 4 days
of notification. Any Entrant who does not confirm their acceptance and confirm the relevant
details within 4 days will forfeit their opportunity to be a Joy! Product Tester.
6. This promotion starts on 22nd March 2023 and ends 5pm on 29th March 2023, but may
be extended or cancelled at any time without prior notice.
7. To enter the Promotion, the claimant must submit their entry on the promotion entry form
between 22nd March 2023 and 29th March 2023. We may extend or cancel this
promotion at any time without prior notice.
8. The requirements of the product testing will be communicated with the successful Entrants
who have been selected to be a Joy! Product Tester and they will be required to:
a. Commit to use the Product for the required period; and
b. Provide a written review at the end of the Trial period, by the date set out by the
promoter.
9. The promoter reserves the right to (a) modify, suspend, terminate or cancel the promotion
at any time without notice; (b) substitute the prize or part of the prize with a prize to the
equal value and/or specification. The gift is not transferable or exchangeable and cannot be
taken as cash.
10. Any cost associated with accessing the promotion is your responsibility including
telecommunications and internet service provider charges.
11. Except for any liability that cannot be excluded by law the promoter including its officers,
employees and agents excludes all liability (including negligence), for any personal injury, or
for any loss or damage (including loss of opportunity), whether direct, indirect, special or
consequential, arising in any way out of the promotion, including, but not limited to (a) any
technical difficulties or equipment malfunction (whether or not under the promoter’s
control); (b) any theft, unauthorised access or third party interference; (c) any registration or
claim that is late, lost, altered, damaged or misdirected (whether or not after receipt by the
promoter); (e) any tax liability incurred by a winner or entrant; or (f) from use of the prize.
For the avoidance of doubt, nothing in these terms and conditions limit, exclude or modify
or purports to limit, exclude or modify the statutory consumer guarantees as provided under
New Zealand Consumer Law.
12. The promoter collects personal information in order to conduct the promotion and may, for
this purpose, disclose such information to third parties, including, but not limited to, agents,
contractors, service providers, suppliers and as required by law. Please see the promoter’s
privacy policy.
13. By entering this promotion, claimants agree to receive marketing and general information
from the promoter.
14. If the promoter does not enforce any of its rights under these terms and conditions at any
stage this does not constitute a waiver of those rights.
15. These terms and conditions are governed by the exclusive laws of New Zealand and come
under the exclusive jurisdiction of the New Zealand courts.
